By now, the question is no longer res integra. Order XL of the Code of Civil Procedure confers a wide discretionary power upon the Court to appoint a Receiver whenever it appears to be just, proper, and convenient to do so. In a partition suit, where a co-sharer having a substantial share in the joint property is kept out of possession and deprived of the benefits and income arising therefrom, the appointment of a Receiver is justified even in the absence of proof of waste, mismanagement, or deterioration of the property. Moreover, under Rule 1 of Order XL of the Code of Civil Procedure, the appellate Court has the jurisdiction to appoint a Receiver in an appropriate case during the pendency of an appeal. |
